WeCan – Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the websites, platforms, and services we operate (“Platforms” and “Services”). By using our Platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not accept these Terms, please discontinue use of the Platforms and Services immediately.
WeCan has adopted the Australian Charter of Healthcare Rights, and we seek to uphold these principles in all patient interactions.
1. ABOUT WECAN
1.1 Who We Are
CAN-A-BLISS PTY LTD trading as “WeCan” (ACN 666 440 419) (“We,” “Us,” or “Our”) is a telehealth clinic dedicated to improving patient access to safe and informed medical cannabis care. Through our Platforms, we facilitate secure online consultations with licensed Australian healthcare professionals who may assess your condition, provide medical advice, and if clinically appropriate, arrange for prescriptions and referrals.
1.2 Our Services
Our Services may include:
- Online consultations and communications with Australian-registered health practitioners (“Affiliated Providers”) who may prescribe medications, request pathology tests, or recommend treatments for your condition.
- Access to educational information, support tools, and ongoing guidance to help you navigate your healthcare journey.
- Facilitation of the dispensing and delivery of prescription medications (including cannabis-based therapies) and other products from third-party pharmacies and delivery services (“Affiliated Pharmacies” and “Affiliated Couriers”).
Note: WeCan does not operate as a pharmacy, nor do we control the clinical decisions of the healthcare practitioners you interact with through the Platforms.
2. ACCEPTANCE & ELIGIBILITY
2.1 Agreement to Terms
By creating an account or using our Platforms and Services, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you disagree with these Terms, you must not use the Services.
2.2 Eligibility
The Services are intended for Australian residents aged 18 years and over, accessing our Platforms from within Australia. If you are under 18, you may only use the Services under the supervision of a parent or guardian who consents to these Terms on your behalf.
2.3 Changes to the Terms
We may amend these Terms at any time by posting updated versions on our Platforms. Continued use after changes are posted constitutes acceptance of the updated Terms. We will provide notice of material changes where required by law.
3. ACCOUNTS & USER RESPONSIBILITIES
3.1 Account Creation
To access certain Services, you may be required to create an account and provide personal, including health-related, information. You must ensure all information is accurate, complete, and up-to-date. You are responsible for maintaining the confidentiality of your login credentials.
3.2 Personal Information & Privacy
All personal information you provide is handled according to our Privacy Policy. By using our Services, you consent to such handling.
3.3 Accurate Information
You agree to provide truthful and comprehensive information during consultations and interactions. Omitting or falsifying information may lead to inappropriate treatment and could result in the suspension or termination of your account.
4. HEALTHCARE SERVICES & CLINICAL INDEPENDENCE
4.1 Patient-Practitioner Relationship
Any healthcare practitioner you consult through WeCan’s Platforms is responsible for their own clinical advice, record-keeping, and compliance with professional standards. WeCan is not a party to the patient-practitioner treatment relationship and is not liable for any medical advice or services rendered.
4.2 Scope of Services
Affiliated Providers will use their clinical judgment to assess whether telehealth is suitable for you and whether to prescribe medications or recommend further tests. We do not guarantee that any particular treatment or prescription will be provided.
4.3 Prescriptions & Medications
All prescribing decisions rest solely with the Affiliated Provider. The availability of any prescribed medication depends on the Affiliated Pharmacy’s ability and willingness to dispense it. Off-label use or compounded medicines may be recommended, subject to clinical discretion and your informed consent. WeCan makes no warranties about the availability, efficacy, or appropriateness of prescribed medications.
4.4 Additional Support
Non-prescribing healthcare staff (e.g., nurses, allied health professionals) may offer general advice related to your condition. This advice does not replace guidance from your principal healthcare provider.
5. PHARMACY & DELIVERY SERVICES
5.1 Dispensing of Medicines
WeCan is not a pharmacy. If you receive a prescription, you may choose where to have it dispensed. If you use an Affiliated Pharmacy, WeCan may facilitate payment and provide your personal information to the Affiliated Pharmacy and Courier, as required. The Affiliated Pharmacy and Courier operate independently and maintain their own professional responsibilities.
5.2 Delivery & Timing
Estimated delivery times are not guarantees. WeCan is not responsible for delays, lost shipments, or errors in dispensing by the Affiliated Pharmacy. If you experience issues with delivery or product quality, please contact us so we can assist in resolving the matter.
6. PAYMENT & FEES
6.1 Fees
Fees for products and services will be displayed on the Platforms prior to purchase. By proceeding with a purchase, you agree to pay the fees as indicated.
6.2 Changes to Fees
We may change our fees or payment terms at any time. New pricing will apply to future Services after you have been notified. If you do not agree to the revised pricing, you may choose not to proceed with future purchases.
6.3 Refunds
Your statutory rights under the Australian Consumer Law remain unaffected. Refunds may be considered where a practitioner deems you unsuitable for treatment or where there has been a clear error on our part. Otherwise, refunds are issued at our discretion.
7. USE OF OUR PLATFORMS
7.1 Acceptable Use
You must not use our Platforms for unlawful, offensive, or harmful activities. Prohibited conduct includes (but is not limited to) harassment, intimidation, data scraping, introducing viruses, or posting infringing or offensive content.
7.2 Third-Party Content & Links
Our Platforms may contain third-party links or content. We do not endorse or control third-party websites or services, and you use them at your own risk.
8. INTELLECTUAL PROPERTY
All intellectual property rights in the Platforms and Content belong to WeCan or our licensors. You may not copy, distribute, modify, or use our Content beyond what is permitted by these Terms or applicable law.
9. LIABILITY & DISCLAIMERS
9.1 No Medical Warranty by WeCan
WeCan does not provide medical advice directly. Any medical advice, treatment recommendations, or prescriptions are provided solely by the Affiliated Providers.
9.2 Limited Liability
To the fullest extent allowed by law, WeCan is not liable for indirect or consequential damages arising from your use of the Platforms or Services. Liability related to healthcare services lies with the practitioners or pharmacies providing those services, not with WeCan.
9.3 Consumer Rights
Nothing in these Terms excludes or modifies your rights under the Australian Consumer Law or other applicable legislation that cannot be excluded by agreement.

10.2 Legal Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
11. EMERGENCIES
WeCan’s Platforms are not a substitute for emergency services. If you experience an emergency, dial 000 or visit the nearest hospital emergency department.
